Article 10, Section 1 of the Declaration CC&Rs provides the Meadows HOA, the Master Association and their respective agents, right of entry to individual lots in order to inspect the lot for violations of HOA bylaws and to abate any violations following notice to the homeowner, provided that entry is made at a reasonable time.  Any entry made for the purpose of inspection or abatement shall not be considered a trespass or other wrongful act.

Notice of Violation

In the event of a violation of the HOA maintenance provisions, the HOA architectural provisions or the HOA use restrictions, written notice will be provided to the homeowner of fifteen (15) days to abate or remove the violation.

Right of Entry

In the event a homeowner fails to remove, abate or otherwise terminate the violation within the time frame specified in the notice of violation, the Meadows HOA, the Master Association and/or their respective agent, employees or contractors, have the right to enter the lot for the purpose of abating or terminating any violation or breach or any attempted violation of any of the CC&Rs.  Such abatement will only occur fifteen (15) days following written notice to the homeowner with the intention to enter and abate, unless an emergency necessitates a shorter period of time.

Right to Recover Cost of Entry & Abatement

The cost of any such entry and abatement (including administrative costs and reasonable attorneys' fees) will be assessed against the homeowner and lot and will be due and payable immediately.  Any such fees not reimbursed will result in a lien on the property and the costs of collection will also apply.

Entry for Inspection Purposes

The Meadows HOA, the Master Association and/or their respective agents, employees or contractors shall have the right to enter upon any lot at a reasonable time for the purpose of inspecting the lot for violations of the HOA bylaws.
